1. Agreement to these Terms

korriphila.org (the “Site”) is owned and operated by Luxus Capital, LLC, a Florida limited liability company (“Luxus Capital,” “we,” “us” or “our”). By accessing or using the Site, you agree to these Terms of Use (“Terms”). If you do not agree, do not use the Site. Our Privacy Policy, posted at korriphila.org/privacy-policy/, explains how we handle information collected on the Site.

2. Eligibility

You must be 21 or older to use the Site. By entering through the age gate, you confirm that you are 21 or older. The Site is intended for visitors in the United States, and we make no claim that it is appropriate or lawful to use elsewhere.

3. Information only; no online sales

The Site provides history, publications, news and other information about Korriphila firearms, the limited-edition Korriphila HSP-701 and related merchandise. There are no prices, accounts, checkout or payments on the Site.

Items shown as available and all other Site content are for information only and are not an offer to sell. Asking about an item does not create an agreement to buy or sell it, and we may decline any inquiry. Any sale is handled separately and offline by Luxus Capital, through properly licensed channels where the law requires, and is subject to separate terms and all applicable federal, state and local laws.

4. Firearms content

Firearms content on the Site is general information only. It is not legal advice, safety training or instruction on the use, handling, storage, purchase, transfer or transport of firearms. Firearms laws vary by state and locality, and you are responsible for knowing and following every law that applies to you. Always handle firearms safely and follow the manufacturer’s instructions.

5. Intellectual property

The Site and its content, including text, images, graphics, logos, publications and design, are owned by or licensed to Luxus Capital and are protected by copyright, trademark and other laws. The Korriphila name and branding are trademarks owned by Luxus Capital, LLC and may not be used without our prior written permission.

We grant you a limited, revocable, non-exclusive, non-transferable permission to view the Site for personal, non-commercial use. You may not copy, reproduce, distribute, modify, publicly display, sell or create derivative works from Site content without our prior written permission, except as the law allows.

6. Acceptable use

You agree not to:

  • Break any law or help anyone else break the law.
  • Misrepresent your age, or enter the Site if you are under 21.
  • Submit false, misleading, unlawful, threatening, harassing or offensive content through our forms.
  • Send spam or unsolicited advertising through our forms.
  • Try to get around the age gate, reCAPTCHA or any other security feature.
  • Upload or send viruses or other harmful code.
  • Interfere with or disrupt the Site, its servers or networks.
  • Use bots, scrapers or other automated tools to access or copy the Site without our written permission.
  • Impersonate any person or business, or falsely claim a connection with Luxus Capital or Korriphila.

7. Information you send us

Information you send through our forms is handled under our Privacy Policy. Please do not send confidential or sensitive information.

The Site may link to websites, and use services, that we do not own or control, including Google services. We are not responsible for their content, policies or practices. Your use of them is at your own risk and subject to their terms.

9. Disclaimer of warranties

THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT, TO THE FULLEST EXTENT ALLOWED BY LAW. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE OR FREE OF VIRUSES, OR THAT ITS CONTENT IS ACCURATE, COMPLETE OR CURRENT.

10. Limitation of liability

TO THE FULLEST EXTENT ALLOWED BY LAW, LUXUS CAPITAL AND ITS AFFILIATES, OFFICERS, MEMBERS, MANAGERS, EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SITE OR ITS CONTENT. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SITE WILL NOT EXCEED ONE HUNDRED US DOLLARS ($100). Some states do not allow certain limitations, so some of these may not apply to you.

11. Indemnification

You agree to defend, indemnify and hold harmless Luxus Capital and its affiliates, officers, members, managers, employees and agents from any claims, losses, damages, liabilities and expenses (including reasonable attorneys’ fees) arising from your use of the Site, your breach of these Terms, or your violation of any law or the rights of others.

12. Governing law and venue

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. Any lawsuit related to these Terms or the Site must be brought in the state or federal courts serving Sarasota County, Florida, and you consent to the jurisdiction of those courts.

13. Changes

We may change, suspend or stop any part of the Site at any time. We may also update these Terms by posting a new version on this page with a new effective date. Your continued use of the Site after changes are posted means you accept the updated Terms.

14. Severability

If any part of these Terms is found invalid or unenforceable, that part will be enforced to the maximum extent allowed, and the rest of these Terms will remain in full effect.

15. Entire agreement

These Terms and our Privacy Policy are the entire agreement between you and Luxus Capital about the Site, and they replace any earlier terms for the Site.
